POLICIES

TERMS OF AGREEMENT
  1. Delivery Time cannot be guaranteed.
  2. No Cancellations except as noted below.
  3. No Refunds except as noted below.
  4. Client agrees to accept each line item as described on their sales contract.
  5. Client agrees to terms 1-4 above, the terms below & Britt Carter´s service policies.
  6. Prices are subject to audit and correction.
TERMS OF AGREEMENT - REVERSE SIDE OF CONTRACT

This contract supersedes all prior written and verbal agreements and statements made by Britt Carter Representatives.

PAYMENT
  1. A 25% deposit must be maintained on all open orders.
  2. Balance due must be paid upon delivery of each item.
CANCELLING AN ORDER
  1. Under priced orders will be cancelled by Britt Carter when identified upon audit.
  2. Special Orders & Items stocked in Britt Carter´s warehouse can be cancelled if Britt Carter is notified within 24 hours of order placement. After 24 hours but before delivery, a special orders & Items stocked in Britt Carter’s warehouse can be cancelled after a 25% cancellation fee is paid.
  3. Small accessories taken from the showroom can be returned for refund within 10 days if in perfect condition.
  4. Orders for Clearance items cannot be cancelled after the order is placed, no exceptions.
  5. Orders cannot be cancelled when one piece of a set is discontinued, but Britt Carter will assist Client in finding an alternative.
  6. Reorders and Reselections can never be cancelled.
CHANGING AN ORDER
  1. Special orders can be changed up to 24 hours after order placement. After 24 hours, Client agrees to pay a 10% fee before the order can be changed.
HOLDING ITEMS IN WAREHOUSE
  1. Client agrees to take delivery within 14 days of arrival at Britt Carter´s warehouse. If client does not accept delivery within 30 days, the order will be cancelled, items disposed of and the deposit forfeited.
EXCHANGING ITEMS
  1. No store credit or compensation of any kind can be issued for client supplied fabrics.
  2. Clients living over 100 miles away are responsible for all transport costs.
  3. Reupholstered items cannot be exchanged.
  4. Britt Carter reserves the right to refuse to issue an exchange authorization in certain circumstances.
SERVICE & REPAIR POLICIES
  1. Service issues are resolved according to policies in Britt Carter´s Warranty & Service Policies guide.
  2. Britt Carter reserves the right to repair rather than replace damaged items. Repairs are guaranteed according to the original guarantee of the product.
  3. Clients living over 100 miles away are responsible for all service transport costs.
  4. Floor Samples are sold AS IS with no service or warranty. Britt Carter is not liable for subsequent transport or pick up damage to floor samples.
  5. Replacement parts may not always match the original dyelot or finish.
DELIVERY
  1. Client is responsible to ensure furniture will fit into the home as planned.
  2. Britt Carter is not responsible if furniture does not fit or cannot be delivered without risk of damage or injury.
  3. Client must pay balance due at the time of delivery when an item does not fit.
  4. The restocking fee will not be charged if a fit estimate was performed prior to order placement.
  5. Delivery appointments cancelled within 24 hours of delivery are subject to a $50 fee.
  6. Britt Carter is not responsible for alleged damage reported after the delivery team has left the home.
  7. Britt Carter is never liable for any problems arising out of complimentary moving of Clients old furniture.
SAFE USE
  1. Client is responsible for prudent placement, safe use and day to day maintenance of each item. Client agrees to routinely inspect furniture to ensure it is in safe condition. Client is responsible to exercise care when setting up, moving furniture or placing items in furniture to ensure against instability, risk of fire, home damage and to avoid risk of tipping.
  2. Client assumes responsibility to keep furniture away from cigarette, cigar and other ignition sources that could result in fire.
  3. Client assumes responsibility of safe operation of electrical items which if not properly maintained can result in risk of fire.
  4. Client indemnifies & holds Britt Carter harmless for any problems resulting from improper or unsafe use by Client.
  5. Britt Carter is not responsible for any problems related to furniture contact points with flooring, walls or table tops.
MISCELLANEOUS
  1. COM (Clients Own Material). Scraps cannot be returned, additional yardage may be required at client expense to complete the original order or make subsequent repairs. Britt Carter is not responsible for Reupholstery of COM items if fabric cannot be obtained to make a repair.
  2. Variations in color, texture and natural markings of wood, fabric, metal and leather are common and cannot be avoided. Britt Carter cannot be liable for any concerns resulting from such variations. These variations cannot always be represented in showroom swatches.
  3. Britt Carter is not liable for fading under any circumstances.
  4. Britt Carter is not liable for size variations of 5% or less.
  5. Britt Carter is not liable for pilling.
  6. Britt Carter is not responsible when existing headboards and bed frames do not match new items.
CONSEQUENTIAL DAMAGES

Britt Carter is not liable for consequential damages of any kind under any circumstances. This contract is governed by the law of the state of Illinois. Please call 847-735-1180 if you have any questions.

Britt Carter has a firm policy of never sharing your personally identifiable information with an outside party. We do not sell or rent our customer list. Anonymous, non-personally identifiable information, such as your IP address, domain server, type of computer, type of web browser, and address of referring sites (also known as "traffic data") may be collected and used to diagnose problems with our server and to administer our sites. We may also use some non-personal information to compile statistics about how people use our sites. We do not share this information with third parties, unless it is on an aggregate basis.
